On registration in NSW LRS of a plan of road or plan of subdivision creating a new road, road-widening or a pathway which bears:
the land is deemed to be opened as public road. The land comprising the road, road-widening or pathway vests in the local council in fee simple.
Reference marks for new roads placement of reference marks for the purpose of defining new road or redefining road widening must be in accordance with cl.31 Surveying and Spatial Information Regulation 2012.
Plan requirements for parcels to be dedicate to the public as new road or pathway, or addition to existing roads.
