APA own and operate underground high pressure gas transmission pipelines. When they have an easement through property for the purpose of such pipelines it is important that landowners understand restrictions on activities on the easement and implications for changes in land use.

APA also operate high voltage electricity cables which are either underground or aboveground. Where they have an easement through property for the purpose of such cables it is important that landowners understand restrictions on activities on the easement.

APA maintains an interest in the Central Register of Restriction (CRR) even where easements for assets are registered on title. The name on the easement may appear under various names, as assets were built by various entities over time and acquired by APA. In addition APA owns and operates assets under a number of legal entities. Therefore maintaining these interests in the CRR provides the most appropriate point of contact for anyone seeking more information.

In some cases an interest may be registered, before an asset is constructed (at early stages of a new project).

Where there is an interest, APA will confirm the nature of the easement (pipeline or cable name), the date the easement was acquired and the registered easement number. This is in the form of a one page statement.

Legislation APA interests relate to include the NSW Pipelines Act (1967), Pipelines Regulation (2005), State Environmental Planning Policy (Infrastructure) (2007), Gas Supply Act 1996, NSW Electricity Supply Act (1995), Electricity Supply Amendment (Protection of Electricity Works) Act (2006), Electricity Supply (Safety and Network Management) Regulation (2008).

APA's interests do not cover all of NSW. Ausgrid are the largest distributor of electricity on Australia’s east coast, Their network is made up of substations, powerlines, underground cables and power poles, spanning throughout Sydney, the Central Coast and the Hunter Valley.

Ausgrid’s Central Register of Restriction (CRR) interests relate to its electricity distribution network infrastructure.

For a parcel of land that has an interest recorded, a letter and supporting documents will be provided outlining the details of that specific interest and what Ausgrid's requirements are.

Responses to Property Inquiries relate to our proposed interests (not registered on title) and those interests that are not recorded on the Certificate of Title of the Parcel ID nominated with their request. The usual practise is to add any parcels of land into the CRR for any new proposed assets and once those assets are covered by an easement or lease and are registered on title, the parcels of land are removed from the CRR.

Ausgrid's interested do not cover all of NSW. The areas Ausgrid have coverage are: Bayside, Burwood, Canada Bay, Canterbury-Bankstown, Central Coast, Cessnock, City of Sydney, Cumberland, Dungog, Georges, River, Hornsby, Hunters Hill, Inner West, Ku-ring-gai, Lake Macquarie, Lane Cove, Maitland, Mosman, Muswellbrook, Newcastle, North Sydney, Northern Beaches, Parramatta, Port Stephens, Randwick, Ryde, Singleton, Strathfield, Sutherland, Upper Hunter, Waverley, Willoughby & Woollahra.

Legislation Ausgrid interests relate to include the Electricity Supply Act 1995.

Unexploded ordnance (UXO) can be found in most States and Territories of Australia. The Department of Defence has identified and maintains a record of sites affected, or reasonably suspected of being affected, by unexploded ordnance.

Unexploded Ordnance is ammunition which has been fired, but has not functioned as designed and can be particularly dangerous as all the normal safety features have been overcome. In this case, very little handling may be needed to make the item of ammunition function.

A UXO search can be conducted against a specific parcel of land within NSW via the Central Register of Restrictions (CRR). A customer will receive a certificate identifying either the parcel is clear (not identified as a potential unexploded ordnance site), or that Department of Defence have identified the potential for unexploded ordnance to exist on that site.

Where Department of Defence have identified the potential for the presence of unexploded ordnance, the response certificate will include details of the categorisation.

This information allow members of the public and other interested parties to identify land parcels potentially affected by unexploded ordnance and provides advice to manage the issue.

If you should find a suspicious item that may be unexploded ordnance, do not touch or disturb it. The potential for injury is dramatically increased if unexploded ordnance is disturbed. Contact POLICE, they will arrange for military experts to attend and dispose of it.

Information regarding the subject authority’s CRR interests have not been supplied to New South Wales Land Registry Services at this time

NSW Treasury - Office of Energy and Climate Change interests in the Central Register of Restriction (CRR) relate to pipeline easements vested in pipeline licensees by the Minister for Energy under the Pipelines Act 1967.

A CRR search provides a stamped pdf document to the customer with advice on whether the land parcel is or is not affected by a pipeline licence. Where there is a pipeline interest, NSW Treasury - Office of Energy and Climate Change will confirm information on the pipeline licensee or operator including the licence number, contact name and phone number, information from the regulation and sample easement restrictions as to user.

High-pressure pipelines that are not licensed under the Pipelines Act 1967 do not appear in the CRR information that NSW Treasury - Office of Energy and Climate Change manages.

NSW Treasury - Office of Energy and Climate Change suggests the party requesting the CRR search engages with the pipeline licensee contact provided so that the licensee can give more precise information as to the location of the pipeline near the land parcel.

Legislation NSW Treasury - Office of Energy and Climate Change interests relate to is the NSW Pipelines Act 1967 and covers all NSW.

Endeavour Energy is an electricity distribution company that may have an interest on some private properties where distribution assets currently exist, or may be located in the future. An easement is usually granted for this purpose as Endeavour Energy needs to have 24 hour access for maintenance and emergency repairs.

A Central Register of Restriction (CRR) search provides the customer with advice of any approved proposals for new easement requirements Endeavour Energy has in regards to the property in question. A letter stating the interest and a copy of Certified Design drawing if the parcel is affected, both in pdf format will be sent to the customer.

Not all Endeavour Energy assets require easements but this will be investigated and customer will be advised. Even if there is no Endeavour energy easement on the property in question, the assets are protected by legislation.

Legislation Endeavour Energy interests relate to include the Electricity Supply Act 1995 No 94.

Endeavour Energy’s interests do not cover all of NSW. Essential Energy is an energy distributor and NSW Government owned corporation constituted by the Energy Services Corporations Act 1995 (NSW). As a state owned corporation, Essential Energy is committed to the principle of proactive release of information in accordance with the Government Information (Public Access) Act 2009 (NSW).

The Australian Energy Regulator has determined a fee which Essential Energy may charge for the release of information to the public relating to property conveyancing purposes.

Proposals by Essential Energy are recorded in its Geographic Information System (GIS). Information extracted from GIS will include a buffer of 30 metres either side of any proposal. Data is provided by Essential Energy for inclusion in the Central Register of Restriction (CRR) for land parcels where there is a possible proposal.

Essential Energy's CRR responses relate to Essential Energy's future proposals only and does not reflect if any customers have any proposed electrical works on the property.

Essential Energy will advise if any new works are planned for the property that will give rise to Essential Energy acquiring a right or interest in the land.

The information does not apply to any affectation registered on title or any infrastructure protected by the Electricity Supply Act 1995 (NSW) or anything discoverable by physical inspection of the property. A request for information relating to Essential Energy’s infrastructure located on the property (if any) is available on Essential Energy’s website www.essentialenergy.com.au

Heritage NSW, Department of Premier & Cabinet is a government agency that administers the Heritage Act 1977.

Heritage NSW maintains the State Heritage Register, a list of heritage items and places of State heritage significance to the people of New South Wales.

Interim Heritage Orders protect potential heritage items for a period of up to 12 months whilst a detailed heritage assessment is completed to determine the level of significance.

“136 Orders” are emergency stop work orders for a period of 40 days whilst investigations can be made into whether an Interim Heritage Order should be placed.

Parcels of land affected by the above orders are entered into the Central Register of Restrictions (CRR).

If there is an interest on the parcel reference the customer is provided with a stamped PDF document indicating whether the parcel is or is not affected by the Heritage Act.

• Interim Heritage Order (Section 24 of the Heritage Act 1977 (NSW)).

Jemena owns and operates a diverse portfolio of energy and water transportation assets across the east coast of Australia.

The nature of interests recorded on the Central Register of Restriction (CRR) include existing and proposed infrastructure developments associated with the Jemena’s licensed pipeline network in NSW.

For a parcel that is affected, an email outlining the specific nature of the interest, showing the gas pipeline on the parcel is sent to the applicant as well as details on the requirements for any design and construction occurring.

Jemena assets are operated at very high pressure and there are strict requirements for any work occurring near these assets. These requirements are mandatory to ensure your safety. A duty of care exists to ensure there is no compromise to the integrity of the Jemena assets and this includes any design, construction or traversing that may occur on the property. The transmission pipeline operates at pressures greater than 6MPa and is located within easements secured under the provisions of the Pipelines Act 1967 and the Conveyancing Act 1919 (NSW).

Legislation of Jemena’s interests include the Gas Supply Act 1996 (NSW) and the Pipelines Act 1967 (NSW). Jemena have interests throughout NSW.

Transgrid is the operator and manager of the high voltage electricity transmission network in NSW, ACT and other areas of the National Electricity Market (as defined in the National Electricity (NSW) Law), connecting generators, distributors and major end users. Property enquiries are processed by Transgrid through the use of a Geographic Information System (GIS).

All parcels of land affected by the interest/assets of Transgrid are recorded into the CRR. These include the following:

• Access/transmission line/cable easements;
• Substations;
• Communications;
• Leased/licensed land.

The land is described to the Operator in the following fields: Lot, Section, Plan Type, Plan Number

For a parcel that is affected, a stamped affected response is sent through to the applicant.

All non clearances get sent to Transgrid for a response. The data supplied back to the applicant is based on Transgrid's assessment of information obtained from a variety of sources. Any search by an applicant where an incorrect reference is provided will still get passed to the agency for processing.

Where Transgrid identifies an approved proposed interest, a PDF report outlining the specific nature of the proposed interest over the parcel is sent to the applicant.

Transgrid’s Interests cover all of NSW

Transgrid provides daily updates to the CRR to ensure fast responses are provided when possible.

Transport for NSW (TfNSW) maintains a record of sites of interest for rail purposes on behalf of the Transport Asset Holding Entity (TAHE) formerly Rail Corporation NSW. This interest may influence the nature of land use into the future.

Parcels of land which are considered as affected by the interests of TAHE or within the areas of investigation are recorded into the Central Register of Restrictions (CRR)

For a parcel that is affected or identified in an area of interest, the inquiry form is sent to the applicant via email with an affected stamp as well as a letter outlining the specific nature of the interest.

For a parcel which is not affected, the inquiry form is sent to the applicant via email with a not affected stamp.

Note: These responses do not include any interests already registered on title.

All non clearances get sent to TfNSW (Infrastructure & Place) for a response. The data supplied back to the applicant is based on the assessment of information obtained from a variety of sources. TfNSW responds on behalf of TAHE the land owner, Sydney Trains the railway network operator and TfNSW (Corridor Identification & Protection) for specific rail projects.

For a parcel that is affected or identified in an area of interest, a written response or PDF e-mail outlining the specific nature of the interest or non interest is sent to the applicant from TfNSW (Roads) (formerly, RMS). The data supplied back to the applicant is based on TfNSW (Roads) assessment of information obtained from a variety of sources.
