The challenging area of boundary determinations – when property owners disagree about the location of their property’s connecting boundary – is being made administratively easier with a new Determination of Title Boundary Lodgment Checklist from NSW Land Registry Services (NSW LRS).
The new Determination of Title Boundary Lodgment Checklist will assist customers and lodging parties to prepare Form 14TB Determination of Title Boundary for lodgment with NSW LRS, reducing requisitions and delays due to administrative errors or oversights.
The Checklist sets out the key components of the dealing that must be addressed at lodgment time:
- Details of the lodging party
- The parcels of land where the boundary is unclear
- That the person applying for the boundary determination is eligible to apply
- Evidence in support of the application, and
- Correct execution of the document.
The Boundary Determination Checklist has been added to Form 14TB Determination of Title Boundary, which is available is the online Forms Library under Land Title Dealing Forms, and as a resource in the Help Hub.
NSW LRS recommends that customers and lodging parties use the Checklist and the Registrar General’s Guidelines to inform their preparation of a boundary determination application.
The Determination of Title Boundary Lodgment Checklist is for internal use only and will not be scanned with the dealing upon registration or recorded in NSW LRS systems.
About boundary disputes
Disputes over boundaries can occur between property owners from time to time. If two independent registered surveyors disagree on the location of a common boundary, an affected landholder can apply to the Registrar General for determination of a title boundary through NSW LRS.
These disputes are settled by the Registrar General under the powers granted by Part 14A of the Real Property Act 1900.
As part of this process, NSW LRS accepts the lodgment of Determination of Title Boundary dealings before referring them to the Office of the Registrar General for action.
