From 11 October 2021, changes to the land titles system in NSW will mean:
- Cancellation of Certificates of Title (CTs) and the control of the right to deal (CoRD) framework
- 100% eConveyancing via the mandate of 100% of Real Property Act dealings (excluding Determination of Title Boundary) for electronic lodgment through an ELNO by a subscriber
These changes are being made under the
Real Property Amendment (Certificates of Title) Act 2021.
What you need to know
As a result of the abolition of CTs and the CoRD framework on the 11 October 2021, two related services currently available via the NSW LRS Online Portal will be impacted.
- Certificate of Title (CT) inquiry service, where physical delivery and controlling party information will become redundant and information such as the edition number of the CT, may not be a true indication of a transaction on the Folio of the Register.
- Certificate Authentication Code (CAC) service will no longer be a valid verification service.
There will be no impact to Water Access Licence information provided via these inquiry services. The Online Portal user interface has been updated to reflect the primary intended use of these search services. The former 'Certificate of Title (CT) Inquiry' service has been renamed to 'Water Access Licence Inquiry'.
As part of the search results, a message will be displayed to notify users that the information provided for Real Property title references will be impacted.
There will be no bulk updates made to the information displayed through the ‘CT inquiry’ service. All changes to the information will appear from the first transaction made on the Folio of the Register from 11 October 2021.
